Historically, legislation aimed at protecting air traffic controllers and TSA agents has struggled to make progress even in the face of public outrage following shutdown-induced flight delays. Legislative drafting has continued since a particularly challenging 2019 shutdown during the holiday season, leading to a series of bills hoping to assure pay continuity for essential aviation personnel.

More broadly, the Shutdown Fairness Act seeks to ensure that essential federal employees across government can continue to receive pay during shutdowns. Currently, however, these proposals have not gained the unanimous support necessary to bring them to fruition.

The pressure for action is mounting with labor unions urging Congress to adopt one of the many available bipartisan solutions to safeguard aviation workers, emphasizing that funding lapses harm employee morale and undermine the recruitment necessary to maintain effective air travel operations.
