NEW YORK (RTW News) — The jury in Harvey Weinstein's rape retrial revealed a deadlock on Friday, resulting in another mistrial in a high-profile case emblematic of the #MeToo era. This marks the third retrial for the former Hollywood mogul, who has previously faced sexual assault convictions on both U.S. coasts.

Despite having served time for other charges, this mistrial leaves Weinstein's New York rape charge unresolved as prosecutors deliberate the possibility of pursuing a fourth trial. Some jurors, speaking outside the courtroom, indicated that nine out of twelve were leaning towards acquitting Weinstein.

Weinstein, now 74, showed little emotion as he exited the courtroom, with his lawyer expressing satisfaction with the outcome. "It may not be the victory he wanted, but it certainly is a win," attorney Marc Agnifilo stated, highlighting their belief in a favorable outcome should a retrial occur.

The jury’s deliberations began on Wednesday, but after sending two notes indicating they were deadlocked, the presiding Judge Curtis Farber declared a mistrial. The focus during the trial had been on the allegations made by Jessica Mann, a hairstylist and aspiring actress, who claimed Weinstein raped her in a Manhattan hotel in 2013.

Defense attorneys contended that the encounter was consensual, while juror testimony revealed doubts about Mann's credibility. One juror noted that the inconsistencies in her testimony contributed to their doubts, stating, “There were places where we couldn’t trust her word for it.”

Mann, now 40, publicly affirmed her commitment to pursue justice, stating, “I deserve justice, which is why I stand up and face unbearable public scrutiny in the name of a greater good.”

The case against Weinstein has drawn significant attention due to his prominence within Hollywood before the exposure of numerous sexual misconduct allegations in 2017. The fallout from these revelations ignited the #MeToo movement, which called for accountability and change in the film industry.

The Manhattan District Attorney Alvin Bragg hailed Mann's courage, stating that prosecutors would consult her before deciding on the next steps, which are expected to be revealed next month.
