In a landmark decision, Katy Perry has triumphed in her trademark dispute against Australian designer Katie Perry, who markets fashion under her birth name. The appeal concluded on Friday, overturning a previous ruling in favor of Taylor, the designer. The three-judge panel concluded that the pop sensation had established her name as a trademark well before Taylor began her business in 2019.
The judges recognized Katy Perry's extensive global recognition in the entertainment industry, noting that she had enjoyed an "international reputation" long before Taylor sought to register her trademark. Consequently, they invalidated Taylor’s trademark registration, marking a decisive victory for the artist.
Katie Taylor expressed her disappointment following the ruling, likening her legal struggles against Perry to the biblical tale of "David and Goliath." Speaking to the Sydney Morning Herald, she conveyed her devastation over the judicial outcome, reflecting on the challenge of competing against a globally renowned figure.
The judges acknowledged the unfortunate nature of the conflict between two entrepreneurs who worked hard to build their businesses, yet were unaware of each other's existence. “Both women put blood, sweat and tears into developing their businesses,” the judges stated. As Perry's fame surged worldwide, Taylor eventually recognized her namesake and proceeded with trademark registration.
Last year's decision, which favored Taylor, included a creative reference to one of Perry's popular songs, framing the dispute as a "tale of two women, two teenage dreams and one name." With this latest ruling, Perry is now set to focus on her upcoming Lifetimes world tour in early 2025, which will promote her new album, "143," following her recent musical endeavors.
