As pro-life organizations ramp up their legal challenges, several significant abortion-related cases are set to shape national policy.
The fight against abortion is gaining increased traction this year as pro-life organizations engage in several pivotal legal battles that may redefine policies across the nation. From challenging buffer zones safeguarding clinics to calls for defunding Planned Parenthood, these significant court cases are gearing up, with numerous issues on track to reach the U.S. Supreme Court.
A notable development in this movement is the recent expansion of the world’s largest grassroots pro-life organization, 40 Days for Life, which launched the Institute of Law and Justice (ILJ) in August 2023. This organization is taking its fight to protect pro-life advocates from increasing legal challenges and boasts an unbeaten record in court thus far. Their most ambitious case is on its way to the Supreme Court.
A particularly important case is 40 Days for Life v. County of Westchester, which contests a 100-foot buffer zone in Westchester County, New York. Anticipating a possible unfavorable ruling from the Supreme Court, the county has now repealed the ordinance. However, 40 Days for Life is still committed to eliminating unconstitutional speech restrictions that remain in place.
Additionally, critical cases such as Turco v. City of Englewood in New Jersey and Coalition Life v. City of Carbondale in Illinois are challenging local regulations that limit pro-life advocacy around abortion clinics.

Claims point to two clinics in Missouri being involved in promoting the Democratic National Convention, while another in Sarasota, Florida, is alleged to have supported campaign activities for candidate Kamala Harris. Should these allegations be validated, Planned Parenthood could face significant legal entanglements.
Meanwhile, the Supreme Court is deliberating on Medina v. Planned Parenthood South Atlantic, a case that may clarify whether Medicaid funds can be allocated to Planned Parenthood. A decision favoring the plaintiffs could shift Medicaid resources towards women’s health services excluding abortion.
In another critical matter, abortion tourism has emerged, where minors are transported across state lines to secure abortions without parental consent. Two key cases—Matsumoto v. Labrador and Welty v. Dunaway—could establish legal standards around this practice, influencing how states manage cross-border abortion access.
