Cristina Balan, a former Tesla engineer, has won a significant victory in her long-standing legal battle against the company and its CEO Elon Musk. The judgment comes after a panel of appeal judges in California overruled a previous arbitration decision that had dismissed her defamation claims.
Balan lost her job in 2014 after raising safety concerns about a braking design flaw in Tesla cars. Despite an earlier court ruling that seemed to side with Tesla, she expressed a desire to confront Musk and the automaker in an open court. Balan stated that she hopes to initiate fresh legal proceedings now that her case is essentially back to square one.
Known for her significant contributions to Tesla, Balan had her initials engraved on batteries within the Model S vehicles. In past interviews, she has indicated her motivation for pursuing the case stems from her desire to clear her name, particularly for her son, as she battled stage-3B breast cancer.
Initially, Balan’s concerns were dismissed when she pointed out that carpets under Tesla’s pedals posed a potential safety risk. Following her claims, she faced hostility from management, which resulted in her losing her job. She won a wrongful dismissal suit, but it was merely the beginning of a complex legal journey.
In 2019, Balan launched a defamation claim against Tesla after being accused of misappropriating company resources for a secret project. She has consistently refuted these allegations and sought an apology from Musk.
An arbitration decision previously found in favor of Tesla, citing California's statute of limitations, which indicated that too much time had elapsed since the alleged defamatory statements. However, after her appeal, judges from the US Court of Appeals for the Ninth Circuit determined that the California court lacked jurisdiction over the matter, ordering the cancellation of the arbitration confirmation and dismissing Tesla's actions.
Balan's legal journey continues as she prepares to potentially confront Elon Musk in a jury trial.
