South Korean crypto mogul Do Kwon is set to be extradited to the United States from Montenegro amid allegations surrounding the catastrophic collapse of two major digital currencies—TerraUSD and Luna tokens. Authorities from both the US and South Korea have pursued Kwon's extradition for over six months, following claims that his actions led to the company’s demise, causing a staggering loss of approximately $40 billion (£31.7 billion) for investors and causing considerable turmoil in the global cryptocurrency market.
Despite lacking direct extradition treaties with the US or South Korea, Kwon's fate hinged on a protracted legal battle in Montenegrin courts. A statement released by Montenegro's Ministry of Justice confirmed the decision, proclaiming that Minister Bojan Bozovic approved the extradition based on favorable legal criteria laid out by US authorities. Furthermore, it was noted that Kwon had willingly consented to extradition to both nations.
Earlier this year, Kwon and his company, Terraform Labs, faced serious allegations from US regulators, who accused them of "orchestrating a multi-billion dollar crypto asset securities fraud." SEC chairman Gary Gensler emphasized that Kwon and Terraform failed to deliver accurate information related to the crypto assets, most notably regarding the stability claims of TerraUSD. Kwon was accused of misleading investors about the potential for the tokens’ values to rise.
The crisis peaked in May 2022 when both Luna and TerraUSD experienced significant devaluation, causing a domino effect that contributed to a widespread sell-off in the crypto market, impacting cryptocurrencies including Bitcoin. In September 2022, Interpol issued a "red notice" for Kwon’s arrest. He fled Singapore following the failure of his venture, ultimately being arrested in Montenegro as he attempted to board a flight to Dubai.
In March 2023, Kwon was apprehended, and by June of that year, he received a sentence of four months for forging official documents in Montenegro. This extradition ruling follows the prior extradition of Hon Chang-joon, Kwon's former finance officer at Terraform Labs, who was sent back to South Korea after serving time in Montenegro on fraud-related charges. The situation underscores intensified scrutiny and regulatory pressures facing the cryptocurrency industry globally.
